Blackwell receives stay on hearings with ethics commission
As criminal hearings move for former District 61 Representative Gus Blackwell, a stay on the hearings with the Oklahoma Ethics Commission has been granted.
In a filing from Aug. 8 with the Oklahoma County District Court, an agreement to stay civil case proceedings pending the completion of the related criminal proceedings was granted.
The filing states that Blackwell has invoked his Fifth Amendment rights in the civil proceedings against him by the ethics commission. The document further states, "the Defendant is placed in the untenable position of being forced to choose between the assertion of his constitutional rights or a certain examination of alleged facts giving rise to the criminal Information."
The charges against Blackwell stem from allegations of using campaign funds for personal purposes, a failure to report campaign expenditures, knowingly filing false campaign reports and submitting false documents to the ethics commission. The same allegations are made against him in both the civil and criminal proceedings in Oklahoma County district court.
The filing goes on to state, "Here, there is no strong public interest in proceeding expeditiously with this case."
Blackwell continues to maintain his innocence of any wrongdoing, according to court documents, and has invoked his constitutional rights under the advisement of legal counsel.
On Aug. 16, a document filed shows that the Oklahoma Ethics Commission has agreed to allow Blackwell to be relieved of the 10 day response period, pending the outcome of criminal proceedings.
Blackwell faced an ethics commission investigation in March under allegations that he "double-dipped" on expense reimbursements during his time in office. Charges include 44 criminal counts for the embezzlement of $23,741 in campaign funds, for sales per diem claims against the state for overnight stays that did not take place and committing perjury on eight campaign reports. He is accused of misuse of campaign funds, failing to report all contributions and expenses, knowingly filing false campaign reports and submitting faked documents to cover his wrongdoing during an investigation.
Blackwell did not take a plea deal in May that would have allowed him to fully avoid jail time. If convicted, he could face a prison sentence. The ethics commission is requesting that Blackwell be ordered to pay the state treasury at least $60,000 in civil penalties for violating ethics rules and another $14,398 in restitution for missing campaign funds, as well as returning money to donors for unreported contributions, or pate the state treasury another $8,271.
Blackwell's preliminary hearing conference was scheduled to take place yesterday. A continuance for the preliminary hearing has been granted, and will take place on Dec. 2.

Strong Oklahoma earthquake felt from Nebraska to Texas
PAWNEE, Okla. (AP) — One of Oklahoma’s largest earthquakes on record rattled other parts of the Midwest on Saturday from Nebraska to North Texas, and likely will turn new attention to the practice of disposing oil and gas field wastewater deep underground.
The United States Geological Survey said a 5.6 magnitude earthquake happened at 7:02 a.m. Saturday in north-central Oklahoma, a key energy-producing region. That matches a November 2011 quake in the same region.
Geologists say damage is not likely in earthquakes below magnitude 4.0; no major damage was immediately reported Saturday.
People in Kansas City and St. Louis, Missouri; Fayetteville, Arkansas; Des Moines, Iowa; and Norman, Oklahoma, all reported feeling the earthquake. Dallas TV station WFAA tweeted that the quake shook their studios, too.
Saturday’s quake was centered about 9 miles northwest of Pawnee, Oklahoma, which has a population of about 2,200. Earlier this week, the same spot, which is about 70 miles northeast of Oklahoma City, saw a magnitude 3.2 temblor.
An increase in magnitude 3.0 or greater earthquakes in Oklahoma has been linked to underground disposal of wastewater from oil and natural gas production. State regulators have asked producers to reduce wastewater disposal volumes in earthquake-prone regions of the state. Some parts of Oklahoma now match northern California for the nation’s most shake-prone, and one Oklahoma region has a 1 in 8 chance of a damaging quake in 2016, with other parts closer to 1 in 20.
A cluster of quakes in northwestern Oklahoma this year included a magnitude 5.1 earthquake, and several 4.7 quakes were felt last fall before regulators stepped in to limit disposal activity.
Sean Weide in Omaha, Nebraska, told The Associated Press that he’d never been in an earthquake before and thought he was getting dizzy. Weide said he and one of his daughters “heard the building start creaking” and said it “was surreal.”

DATF Agents seize 2.5 pounds of heroin, 1 arrested
An Arizona woman faces an aggravated trafficking of heroin charge after being stopped by District Attorney’s Drug and Major Crime Task Force on Tuesday near Goodwell.
Maria Letisia Duarte-Raya, of Phoenix, Arizona, was placed under arrest after DATF agents seized about 2.5 pounds of heroin.
About 8:40 a.m., agents made an interdiction stop of a Honda vehicle near Goodwell and identified the driver and single occupant as Duarte-Raya. She told an agent that she was delivering the vehicle to a friend in Kansas City and was flying back home later that day.
After further inquiry about her travel plans, the agents became suspicious that Duarte-Raya was transporting controlled dangerous substances. She told agents she had been stopped and that the vehicle had been searched in Arizona the day before. However, agents felt further investigation was needed and obtained consent from Duarte-Raya to search the vehicle.
As they began the search, an agent noticed that it appeared that the front bumper of the Honda had been previously removed. The agent also observed a small amount of foam protruding out of the metal bumper frame work. When agents removed the bumper, they found four small packages that were wrapped numerous times in cellophane and black tape.
Further investigation revealed the packages - weighing 2.9 pounds - contained and estimated about 2.5 pounds of heroin. The estimated street value of the drugs was placed between $400,000 to $500,000 by District Attorney Mike Boring.
The use of heroin is already at epidemic across the nation and has resulted in increased deaths from overdoses. Heroin and methamphetamine are directly related to and have resulted in many violent crimes occurring across the country. The almost free flow of these dangerous drugs across the border from Mexico imposes an ever increasing burden on society in dealing with a host of serious problems associated with drug addiction and drug trafficking.
Duarte-Raya was booked into Texas County jail pending the filing of formal charges in the District Court of Texas County. Her first court appearance is expected next week.
